Children are our greatest resource yet they are most vulnerable to civil rights violations imposed by separating and divorcing parents.

The mission of the Foundation for the Child Victims of the Family Courts:

To act as a referral service in assisting separating/divorcing couples to navigate the legal channels of the divorce process through therapeutic mediation, psychotherapy, non litigation and congenial legal services.

When couples and families are engaged in high conflict disputes; we offer forensic counseling, guidance, informational services and to ethical, legal and therapeutic resources.

Case evaluation is obtainable to assess whether or not there has been any violation of civil rights, ethical violations on the part of evaluators, Guardian ad litem, Judges, Prosecutors, or Attorneys.

Children are defined as Human Beings under the Bill of Rights and therefore have a right to legal recourse or remedies as prescribed under the law and to compensation for injury.

The foundation will access in a fair and unbiased manner, whether a child's rights to be seen, heard, believed and protected have been compromised in any way.

The foundation will confront and remediate violations of a parent's or children's civil rights at the hands of the Family courts and correct any action taken by the court which has resulted in injurious situations, mistakes or violations.

Part of our mission is to assist the parties whose rights have been violated in order to take legal action. We will provide attentive guidance in holding the courts accountable and to remediate wrongful actions taken by the courts through assistance in the filing of criminal and civil litigations.

The foundation and it's affiliate; Law is not Justice, are organizations composed of an association of Attorneys, paralegals, psychotherapists, forensic counselors and pediatricians throughout the 50 states who are dedicated to the preservation of the rule of law under the constitution and who disapprove of the abuses of power forced by family court systems across the country.

Professionals affiliated with The Foundation are individuals whom due to their competence, ethics, and their respect for the constitution and rule of law, are fearless in confronting infractions by the courts.

  • Any affiliate of the court who may evaluate, supervise visits, or are appointed guardians; who do not conform to the ethics and standards of care that protect children and those who truly love them, will be challenged.
  • Any affiliate of the court who wish to transfer children from the custody of their protective parents into the hands of those who abuse, will be challenged and legal remedy will be sought on their behalf.

Jonathan Reid Family Rights  

The Jonathan Reid Family Rights Coalition is committed to ensuring that the Department of Children and Family Services follow the Congressional Reasonable Efforts Act Law of 1980.

This particular law was adopted to assist the Child Welfare Act (Public Law 96-272, 42 U.S.C. Section 620 et. seq., and Section 670 et. seq., that requires prior to placing a child in a agency, there must be reasonable efforts (financial or in-kind benefits or counseling assistance) to maintain the child in the home. To ensure agency compliance with this Act, Congress prohibited the use of foster care payments for any child unless a court has determined that the reasonable efforts were made. We will ensure that these are not mere words permanently a fixed on juvenile dependency court minute orders, but are used to protect families from being unfairly disrupted or intruded on unnecessarily by the government without fairly applying the "Reasonable Effect Law" to every family.

Being nominated is one thing, but to win is crrrrraaazy!!! Like I said with the nomination, this makes it official! It is now confirmed that the responsibility of being put here to be DMC, blessed with the culture of Hip Hop as my foundation, the journey has not ended, but now has just begun. DMC means Deliver My Children! And I'm gonna do exactly that!  We put the most vulnerable children in custody of state and federal government and these children are being forsaken and left to die. There's mental, emotional, physical and sexual abuse and when they age out of the system at 18 and even before starting at the earliest of ages, the only options they have is substance abuse, self abuse, acting out violently, and suicide!!!  But not anymore! There's going to be someone there reppin to the fullest for them! I'm bringing truth and justice for all these kids now, and for the ones already laying in the graves! And for my fellow adoptee's, I am going to remove the guilt and the shame from the triad, birth-mom, adoptee and adopted parents, and thus will remove the pain. If you thought this documentary changed a multitude of lives, my next project will change lives again, change laws, change history and change the world!

The Oklahoma Department of Human Services has taken months to ban many troubled day cares from operating even when children have died or been burned, molested, abused, left alone in cars or wandered unsupervised into the street, an investigation by The Oklahoman found.

Some day cares still had their licenses months after DHS workers or police found marijuana, cocaine or guns. Some still had their licenses months after DHS was told a murderer, rapist or drug offender lived there, records show.

CPS needs citizen oversight
 
More than nine months ago I was contacted by an Enumclaw family whose granddaughter had been swept into the Child Protective Services system and was being put up for adoption. They were riddled with fear and tears. Terror is the word.

There was no accusation of child abuse. There had been an argument between the grandparents and their daughter (an unwed teenager) over differences in child rearing. The 2-year-old was put in the foster adopt system. The law that requires placement with qualified relatives was ignored and termination proceedings were started.

As this was happening, a 14-year-old girl was being held captive by her parents. Abused and starved, she weighed 47 pounds when police found her.

At 11, the girl had sought asylum. She told a teacher. CPS was called. Social workers looked at the 60-pound preteen begging for help and then, after a short interview with the family, left her in hell.

In Region 5 (Pierce and Kitsap counties) of the Division of Children and Family Services, eight children with open CPS cases have died since the beginning of 2008. Six were murdered.

And, in that region there are other open case atrocities, such as the 3-year-old whose mother blinded her with a pin.

The public sees only the headlines. The agency is fraught with mismanagement and lack of accountability that has led to tearing apart good families, maiming children and even death.

Citizens and legislative leaders need to hold this agency accountable. But, since the cases deal with the powerless and poor, the agency proceeds with impunity.

Only a few have the resources to sue the state. Last year we paid out millions of dollars in judgments. That's not enough in my mind because so many families have not had their day in court.

We need to split the monolith. The Department of Social and Health Services is too big to be accountable.

During the 2009 session, I will re-introduce my proposal of 12 years ago. The intent section will be the same, as nothing has gotten better. If passed, the $19 billion-a-year agency would be divided into four, more manageable units. We would create the departments of Children and Family Services; Public Welfare; Medical and Rehabilitative Services; and Centralized Services to include management services, research and planning, legislative and community relations and constituent relations.

I am also proposing that a "Social Services Transparency Board" be established. This citizen oversight committee could be established without legislation. But the agency does not want outside review.

The transparency board is modeled after the "Sunshine Committee" that was established to review laws that prohibit access to government records. The people have a right to know government information. And, the only way government can be held accountable is to be open to public scrutiny.

I am proposing that one legislator from each caucus and a number of citizen appointees (not DSHS heads) be members of the committee. DSHS needs direction from nonagency types. The "culture" of this agency of government is ardently resistant to citizen oversight. And, unlike every other department, there is no powerful entity with money to move forward with court appeals.

The transparency board would be charged with reviewing accountability measures within the department and suggesting changes that will yield a less expensive yet better outcome for the public. Specific cases should be reviewed. Public testimony would be taken. Internal accountability would be defined.

The current director of DSHS, Robin Arnold-Williams, could propose this herself. Instead, she hired a former editorial writer at $100,000 a year to spin away problems for the department.

Until fundamental changes are made, the destruction caused will continue to make headlines and overshadow some of the good work that is done.

I am a former prosecutor of juvenile dependency cases for the Los Angeles County Office of the County Counsel. I served in that role for two years, as long as I could stand it, before quitting and changing sides in order to represent parent, legal guardians, de facto parents, relatives of dependent children and others including some minors (though the courts are very resistant to outside counsel representing the children since they have their own in-house court-created firms, CLC 1,2 and 3.). I left prosecuting because of L.A. County's Department of Children and Family Service's (DCFS) policies of self-protection, and win-at-all-costs approach to cases which they filed in the court on behalf of the kids for whose protection and best interests they supposedly were looking out. Lying and manipulation of facts are minimally as rampant in DCFS's reports as in San Diego's CPS's reports. They County Counsel's here are generally noble, but they stand by the social workers in court even when they have serious reason to know that the social workers have manufactured, manipulated or omitted essential facts and evidence. They and the DCFS view it to be the defense attorney's job to defeat them if they can, and when the defense attorney fails to do so, it is the defense attorneys fault, or the case was righteous. Thus, the Deputy County Counsels and DCFS social workers can sleep at night, despite their insideous disregard of families and children whose interests they are there to preserve and protect.

I and my law firm, Komanapalli Massey LLP, love to take on these sociopathic DCFS social workers and the attorneys who represent them. I find the use of the foster family agencies who harbor the children detained by the DCFS, or the independently licensed foster parents also employed by the DCFS, so long as they play along with the DCFS's game plans, useful sources of truth, generally unintentionally yielded up, because they are usually not as trained in the art of deception as are the DCFS's social workers. Parents attorneys and others with interests in kids caught up in the wretched dependency system without just cause ought to bear that tip in mind as they go about building a defense against the presumption of guilt imposed upon them at the outset of cases involving their child wards. It help to remind the foster parents, in order to obtain their assistance, that they can sue the DCFS for lots of money as soon as the DCFS retaliates against them in response for their betrayal -- their audacious exposure of arrow-sharp truth aimed at piercing and deflating the ballooning deceptions manufactured by the commanding DCFS. Invariably, the DCFS does delist the foster parent who exposes the truth about kids statements and the manipulations thereof by the DCFS and those enlisted by the DCFS to help build their case against the parent or other caretaker whose rights and interests in the subject children, in maintaining their families unimpeded by a second-guessing, paternalistic government, the DCFS has wrongly infringed.
