Question to Children Protective Services 

What Are We Doing To Our Children?

Once again, a child died. As usual, we learn that Child welfare officials were familiar with the family, but naturally they did not do anything to prevent the death from occuring. Once again, a CPS worker had the opportunity to know that child was in danger. Once again, the wrong decision was fatal.

If you don't have over 2 million falsely accused families for child abuse,or the newborns taken from the delivery room  maybe..... than you will be able to save those Children's life.

If  states can't keep children safe, how can they take children from their parents? There are hundreds of incidents of children being killed in foster care. It is proven that government is a terrible, abusive "parent". The government should have parental right removed, permanently!

"The phenomenon of children dying in state care is one that deserves special scrutiny.We know that there are many more deaths than made the newspapers.The total number of children who die annually while under state care is unknown.While multiple agencies track their numbers, no central tracking agency exists and tracking methods differ between agencies.That's one of the issues should be addressed." "Our system is broken. The Department of Human Services is a mess. It's terrible for kids.We still have children dying. We still have children being moved around. The more we ignore the reality of this, our children are going to pay." said Rep. Richard Morrissette, D-Oklahoma City, a frequent critic of DHS who has called for the agency to be broken up into three separate parts to better focus its resources on children and families.
 
Since 2002, 30,000 children have died from child abuse, suicide or homicide in the United States, compared with about 5,000 American troops who have died in Iraq and Afghanistan. Should it be any different for CPS?

 America's dead children and Child Protective Services
 
In this country when someone breaks the law, whether it is a police officer, a doctor, or an ordinary citizen they are charged with a crime.  Should it be any different for CPS? 

When a doctor is negligent in performing his duties and his patient is injured or killed because of that negligence he is held accountable.  Should it be any different for CPS?
 
When a child dies, and there is even the suspicion that the other parent could have known of the abuse, that parent is charged with failure to protect.  Should it be any different for CPS?
 
When a government agency in this country isn't following the law, and performing its duties as required, they are investigated and if needed, the Federal Government intervenes to make them perform those duties or shuts them down.  Should it be any different for CPS?

Hidden Abuse in LA's Foster Care System
 
Lawmakers have a habit of racing too quickly to solve one highly publicized problem, only to inadvertently create a whole new set of problems. If we are not very careful, Los Angeles County is heading straight toward a bunch of unintended consequences in reaction to a pair of tragic events relating to LA's foster care system.
 
Let me explain:
 
Because of the nature of much of my past reporting, I've monitored at close range a number of cases where the Department of Children and Family Services swooped in and took kids away from their parents and into foster care. In the cases that I happened to observe, the kids were put in the system, not because of some kind of hideous neglect or because they were being physically or sexually abused, but because an otherwise decent parent made a lousy choice. Most often it was that somebody in the family's house had been busted for drug possession and/or dealing.
 
As a consequence, the kids were yanked away from everything familiar, from the people who loved them, from their friends, their school, their siblings, and put in a house with strangers.
 
And, guess what? They did poorly in the county's care. It was awful. Damage was done. No, of course, it is not good for children to grow up in a household where drugs are used or in evidence, or where somebody's boyfriend or husband or cousin gets arrested for dealing..any of those things. But there are ways to intervene in the lives of children, while also keeping the families together.
 
Yet, I found that the system is designed--and incentivized really--to do other than that.
 
In the past I had always been of the impression that the problem with LA's foster system is that social workers didn't take kids away from bad parents soon enough, so terrible things happened, as in the heart shattering cases of Dae'von Bailey and Lars Sanchez. Or that DCFS occasionally placed children with foster parents who turned out to be monsters.
 
But reporting in and around the DCFS system, I learned that while the horror stories do happen, they are the rarities, the lightening strikes. And certainly there are plenty of non-monstrous, non murderous but abusive and neglectful parents who need to have their kids removed until they can get their respective acts together (if they can get their acts together).
 
However in the cases I followed, I encountered a much different kind of abuse: For instance, with the family I followed the mostly closely, I saw six kids removed for mind-numbingly stupid reasons from the care of parents who were, on balance, very loving and caring--imperfect, but good enough. I watched as those same children were separated from each other and shoved into the maw of a system that behaved toward them with haphazard indifference on its best days. When finally the parents got their family back a half year later, the effect on the kids had been utterly traumatizing. There was no other word for it. The parents too were deeply traumatized.
 
And it didn't have to happen. No good was served.
 
Now because of the panic over those two high profile deaths, the County Supervisors are stumbling over each other in their haste to make it still easier to take kids away from parents, and harder for the parents to get them back.
 
This is a potentially disastrous fix.
 
Wednesday's LA Times has a crucial Op Ed by Richard Wexler, the executive director of the National Coalition for Child Protection, who talks about this issue in knowledgeable detail.
 
I hope very much for the safety of LA County's children that those in position to make decisions on such matters take to heart what Wexler has to say. If they do not, there will be hell to pay. And it will be a hell visited mostly on certain unlucky children.
 
Here are a few clips:
 
Gerardo R., as he is known in court documents, never beat his children. He did not torture them or stab them or brutalize them. He was a loving father who'd always been a part of his children's lives -- and when their mother lost custody, he immediately stepped forward. But he had to fight for his children's right to live with him.
 
Why? Because he was unable to afford housing deemed satisfactory to the Los Angeles County Department of Children and Family Services. For that, his children were denied the chance to live with their father and even had their right to have him in their lives terminated forever, until a California appellate court intervened.
 
There is nothing unusual about such cases. Contrary to the stereotype, most parents who lose their children to the county and to foster care are nothing like the sadists and brutes who make headlines. Tragedies like the ones this summer -- in which two youngsters, Dae'von Bailey and Lars Sanchez, were killed within family units that the county had evaluated -- are rare. Far more common are cases in which parental poverty is confused with parental neglect.
 
As it turns out, it is a serious mistake to pull children out of their homes just because their parents are poor or imperfect, just as it is a mistake to leave them in homes where parents are dangerous brutes. A landmark study of 15,000 typical foster care cases showed that children placed in foster care usually fared worse in later life than comparably maltreated children left in their own homes.
 
The foster children were more likely to commit crimes, more likely to become pregnant as teenagers and less likely to be able to hold a job as young adults. Another study found that only one in five former foster children was doing well as a young adult. That's not really surprising, considering that foster children often bounce from placement to placement, emerging years later unable to love or trust anyone.
 
These everyday horrors of foster care don't get much notice; they accumulate over years, and they are often hidden by confidentiality laws that protect not the children but the child welfare system itself. So the public, understandably, assumes that the only mistake the system makes is to keep children in dangerous homes.

Do closed juvenile court hearings protect children -- or the adults who are supposed to take care of them?
 
We think it's quite often the latter -- that it's the adults who benefit, undeservedly, from the secrecy of juvenile court hearings.
 
We don't think people accused of abuse or neglect deserve that blanket of protection. Nor do we think the child welfare system works better in the dark that it would in the light.
 
Let's have some accountability. For kids' sake.
 
Why, for instance, was the Burke County Department of Family and Children's Services so eager to return four children to a woman who, with her husband, are accused of keeping them and seven others out of school and in the worst running-water-and-electricity-free squalor you can imagine?
 
Christine Long and her husband Jeremy Long had 10 underage children and one 18-year-old removed from their home last July 31.
 
"According to the prosecutor's motion," said a news story last week, "there was no food in the house. There were no beds for the children, and they didn't have proper clothing or shoes -- two had never worn shoes. None had been vaccinated or given dental care. The younger children suffered from malnutrition. The children range in age from 1 to 17."
 
And yet, DFCS not only wanted to return the four oldest children to the mother (while charges are pending), but was indignant that Superior Court Judge David Roper would intervene in the case and block the plan after the district attorney's office asked him to.
 
Then came the request to kick the public out.
 
You know what? Folks are pretty tired of this claptrap. We're tired of self-righteous attorneys and social workers trying to hide behind the kids' privacy and tell us it's none of our business.
 
You're doggone right it's our business. When kids are found in squalid conditions like that, it becomes the public's business.
 
We applaud Judge Roper for having the courage to get involved and for refusing to close the hearing to the public.
 
And we condemn child "welfare" officials for ignoring the recommendations of the children's advocates, as they did in this case -- and for trying to shut out society.
 
At least 59 Georgia children died from abuse or neglect in 2007 -- some of them after being returned to their families from foster care, according to Better Courts for Kids, a group advocating juvenile court reform.
 
One Georgia toddler who survived was beaten within inches of her life, advocates say, after DFCS and a juvenile judge ignored the warnings of a guardian ad litem, a citizens review panel and a Court Appointed Special Advocate.
 
The state then refused to open the child's file for public inspection, despite clear legal obligations to do so.
 
The system isn't protecting kids' privacy; it's protecting itself from scrutiny and accountability.
 
Senate Bill 207, approved by the Senate and now in the House, would change that, by making juvenile hearings open unless closed by a judge.
 
Do it. Let the light in.

How To Fail A Child - The American Foster Care Way

 For the more than one half million children in foster care across the United States, the number "18" is forever on their minds.  For some that number means the birthday they must reach to be "aged out" of a system they find restrictive and abusive.  For many others it means the birthday they will reach and find themselves cast out of a home environment into a world they are ill prepared to face alone.
 
"Aging Out" of the foster care system is as mixed up and convoluted as the entire government operated foster care program in general.  Some states continue to take care of the child through training programs, free college tuition, healthcare and other options until they are prepared to function independently.  Many states end all support and payments the day the child turns 18. 
 
Girls who reach 18 find themselves homeless and without finances unless they are pregnant or have already given birth to a child.  Motherhood means they will continue to receive welfare support.  Perhaps that is why almost 40% of the girls raised in foster care find themselves pregnant before the age of 18.
 
At age 18 most boys find themselves alone, homeless and undereducated.  It is estimated 25% of these boys will remain homeless.  Many become engaged in criminal activity or male prostitution.  Few find themselves with positive prospects for the future.
 
A recent survey of foster care alumni reported that only 20% of the children who have been placed in foster care do well in society once they reach adulthood.
 
It is the foster care system itself that completely fails the children.  Some states operate these programs better than others.  Some states have horrible systems.  None could be called exemplary.
 
Illinois can be spotlighted as one of the states having a failed foster care system.  Reports on the program are never up to date, but four years ago, with close to 19,000 children in foster care the state had wracked up a significant record of irresponsibility.  In its mandate to protect and care for children who were wards of the state, Illinois had 100 children who had been relocated 50 times or more.  There were 1,000 children who had been moved to at least 23 different places.  There were 750 children who had been placed in ten or more different foster homes.  It was among 13 states across the country considered the worst for multiple relocations of children.
 
Added to its list of failed policies is the Illinois system of sub contracting the foster care of children to private agencies?  These agencies vary in quality from strong church operated programs to for-profit groups whose only incentive is the money they receive from the state.  To make sure the "wealth" is spread around, the state has a rotation system of passing foster children out to various providers care.  The next one in line receives the next child to be placed.  No thought is given to how many foster families a particular private contractor has in its system or if the correct foster home is available for the child to be placed.  Thus a child could end up in a group home with perhaps a half dozen children of varying ages and emotional problems.  At the same time another private agency might have an opening for a single child to go to a family with no other responsibilities.  However, that agency was not at the top of the rotation list.
 
But, Illinois is not alone in its multiple failures.  In the rich Napa Valley of California federal standards for foster care have been continuously ignored.  Not too long ago Napa was found to be in violation of seven out of the twelve federal standards.
 
In point of fact, all 50 states have failed to comply with federal child-welfare standards developed to protect children from abuse and neglect.  The most frequently ignored standard is to assure there is permanency in the child's living arrangements.
 
The Florida system is what many call "The take the child and run program".
Because of national abuse cases that have been highlighted by news media, case workers in Florida worry they will be blamed if anything happens to a child.  The answer for these employees is to remove a child from his or her family when there are allegations of neglect or abuse, even if such charges are not confirmed.  Florida now has a child removal from the family record 35 times higher than the national average.  Though, in theory, such removal practices may be justified, the reality is these children are separated from everyone they love and who love them in return.
 
The subject of child protection caseworkers, or social workers is one that really needs to be explored in depth.  In many states they are poorly evaluated as to their capabilities.  Often there is little to no training.  They are all under staffed and under paid. 
 
Children in foster care usually are visited by multiple caseworkers during those months or years they are wards of the state.  Some have reported that a single child could have, over a period of time, thirty or more different caseworkers.
 
Not too long ago a case in Texas made national headlines.  Three small children were killed and beheaded by their parents.  Police found the home and living conditions to be complete squalor.  The parents were deeply involved in drugs.  Also, among their findings the police learned there had been a variety of complaints filed against the parents, but no caseworker had visited them in months.
 
Records reveal that 11 children have died in the state due to abuse and neglect while in foster care.  Though this may not be an accurate total and it doesn't seem to be a large number when viewing the size of the state and its population, it is still ten times the child abuse death rate found in the general Texas population.
 
According to USA Today, "All 50 states have failed to comply fully with federal child-welfare standards designed to protect kids from abuse and neglect, according to reviews (held) since 2002 by the U.S. Department of Health and Human Services."
 
That report further revealed not a single state met the very important requirement that all children should have "permanency and stability in their living conditions."
 
There is a strange paradox to the nationwide foster care debacle.  Across the United States voters not only support a strong foster care system, but demand it.  When this message is transmitted to those who provide the legislation or governance for the states, there is never enough money, time, talent or training put into developing positive, productive and protective programs.
 
Extensive investigation needs to be the rule, rather than the exception into all families where children are to be removed for cause.  These same investigations need to be the rule for all families seeking to be foster parents.
Foster parents, caseworkers.and yes, the families who have lost their children to the foster care system, need to undergo psychological testing and evaluation.  They need to receive strong training in childcare and development.  They need a regular system of inspection and evaluation of performance .and above all they need the dollars to keep a quality system in place. 
 
Pearl S. Buck once said it best."If our American way of life fails the child, it fails us all."

More young people are running away from residential and foster homes - often egged on by predators. But the police know more about missing cars than they do about the children supposedly in society's care. Brian Brady and Jonathan Owen report
Hundreds of children are going missing from Britain's care homes and foster families each year, many falling victim to violent and sexual abuse, prostitution and drug addiction.

Some of the most vulnerable children in society, who are supposed to be safely in care, are instead singled out by predatory paedophiles or drug dealers and encouraged to run away repeatedly, according to child welfare campaigners.
 
Amid growing fears for the fate of missing nine-year-old Shannon Matthews in Dewsbury, Yorkshire, and allegations of widespread abuse at care homes on Jersey, it was revealed that almost 1,000 of the most vulnerable young people in the country went missing from residential and foster care last year, according to new government figures.
 
Officials from the Department for Children, Schools and Families (DCSF) admitted that the number "who went missing and remain missing" stood at 160 on 31 March 2007 - an increase of more than 10 per cent on the previous year. And police figures reveal that more than 100 other children who should be in care have been missing for at least four years.
 
The number that went missing from care increased from 570 in 1997 to 950 last year. More than a third of these were gone for more than a month.
 
Many local authorities around the country have lost dozens of children in their care, with some regions seeing the highest ever numbers of missing children last year.
 
The charity Missing People said young people living in residential care are three times more likely to run away than young people living with their families. They are also vulnerable to abduction by their natural families, or being groomed into absconding by predatory criminals. "The issue of missing children spans across those missing from home and care, whether they have decided to run away, or been forced to leave. Missing People is concerned for the safely of all missing children, many of whom are some of the most vulnerable in our society," said a spokesman for the charity.
 
A DCSF spokesman said: "Most young people who do go missing are found again very quickly - they may have simply gone to the shops without telling anyone or walked away to calm down after an argument, as many children who live with their parents do." He insisted there are "robust systems" in place to ensure children's safety, including protocols with the police setting out arrangements for finding children promptly if they do go missing."
 
But child-protection experts, pressure groups and MPs called for better care for runaway children and a national database to help to co-ordinate efforts to find those missing.
 
Despite repeated calls for action over many years, there is still no single source of information that collects data about Britain's missing. Campaigners claim that the official figures mask a bigger problem, as many who go missing are not even reported to police.
 
Labour MP Helen Southworth, who is leading a parliamentary inquiry into missing young people, accuses police of knowing more about missing cars than they do about missing children. "All figures on children missing from anywhere are estimates because, astonishingly, there is no requirement for data to be recorded or collected nationally," she said.
 
"Police have a key performance indicator set by the Government on vehicle crime, so they allocate resources and collect information. Children are more important than cars, but the DCSF collects no data on runaway and missing children."
 
Catherine Meyer, founder of Parents and Abducted Children Together (Pact), said British police are "decades behind" America counterparts in reacting speedily and efficiently to find missing children. "The terrible thing is that since we don't have a centralised database and a centre for missing children, we don't know how many of them are going missing or what is being done to find them," she said. "If a government or a local authority doesn't know exactly how many of its children are going missing, they can say they don't have a problem."
 
Police chiefs said that many children who go missing become involved in crime, including drugs and prostitution. A national database would help, they admitted. Inspector Ian Carter, spokesman on youth issues at the Association of Chief Police Officers, said: "The situation is that every force deals with this in their own way. There isn't a national database, but I think it would be very helpful if there was one. It would give us the bigger picture. With that type of intelligence we could perhaps become proactive rather than reactive."
 
At least 100,000 children go missing in the United Kingdom every year, with some estimates putting the total as high as 140,000. Child-protection experts have found that one in every nine children goes missing from home at least once before they are 16.
 
Local authorities, police and charity workers say the vast majority return safe and well within 72 hours. But as many as a third of them stay with a stranger and more than two-fifths sleep rough. Research by The Children's Society suggests that each year 10,000 children are hurt or harmed while missing. A 2003 survey found that one in nine was sexually assaulted while away from home.
 
But many fail to return at all. The Police National Missing Persons Bureau, the closest the UK has to a national database, has 1,418 "open cases" of children missing since records began. Of these, some 509 new cases were reported between 2002 and 2005. This increased to 639 in the three years since.
 
Social services departments are also being stretched by growing problem of young asylum-seekers who vanish from care soon after arriving alone in the UK - amid suspicions they have been taken by human traffickers. The problem prompted Unicef, the United Nations children's agency, to demand action. Jana Sillen, Unicef's UK policy officer, said: "We want the Government to address the issue of children going missing from care. Many of these children are victims of trafficking."
 
Martin Houghton-Brown, a policy adviser at The Children's Society, said "pull factors" such as a failure to settle in a home or a desire to return to their local area often forced children out of local authority care. "Some young people are targeted for exploitation, usually sexual, by groups of people when they are running away," he said: "The survival strategies that they come up with to support themselves, such as begging, stealing and sexual exploitation, add to the problem."
 
He said local authority provision for young runaways was "incredibly patchy", and that only 12 per cent of local authorities had organised responses to the needs of young runways. More than two-thirds are not planning a response, he claimed. Two out of 10 police forces are unable to provide information about the level of need in respect of runaway and missing children in their area.
 
Wes Cuell, NSPCC director of services for children and young people, warned: "There is a danger of the most vulnerable - the ones where there is a pattern of running away, staying away for long period of time, or who have not been found - being lost in the sheer number of cases reported.
 
"Looked-after children are frequently targeted by people who have evil intentions towards them - people selling drugs will frequently target children they know are being looked after, particularly ones from residential care.
 
"There are a lot of children who remain missing and never turn up. The system allows the risk that if a child goes missing and is still missing after several months, the chances of some sort of long-term effort made to find them are slim; the resources are just not there. I think some children that have gone missing are dead. A lot of them are living on the streets and being exploited by others."
 
Nicki Durbin, whose 19-year-old son Luke disappeared after a night out with friends two years ago, has organised the March for the Missing which will start at 32 Great Cumberland Place, London, at 10am on Wednesday.
 
'Sarah was just another statistic to the social services'
 
Sarah Benford was 14 when she disappeared from Welford House children's home in Northampton in April 2000. She had been taken into care because her mother was worried about the drug addicts and petty criminals Sarah had begun to associate with in her home town of Kettering.
 
Eight years on she remains missing, although police believe she is dead. A long-running murder inquiry in 2003 involving dozens of detectives and several arrests came to nothing. But her uncle, Stephen Cross, says the family lives in the hope that she might still be alive.
 
"We all wait for that knock on the door or that phone call and we always will... The way the whole family thinks is that there is still hope that she is still alive, that's what keeps us going," said the 43-year-old, from Corby, Northamptonshire. Sarah's disappearance has left the close-knit family traumatised and still struggling to come to terms with their loss.
 
Mr Cross remains haunted by memories of his niece. "Several times I've seen someone that looked like Sarah and jumped out of the car to approach them, only to find they were not her."
 
He is still angry at how Sarah's disappearance was treated by the authorities. "The police have told us that as far as they are concerned she is dead, but I think all this could have been avoided. They didn't treat it seriously enough at the beginning. Sarah was just another statistic to the social services and the police, and to start with they didn't care. But then with pressure from the family through the media they thought, 'We'd better do something about this because it isn't going to go away'.
 
"There is a culture of secrecy when kids from care homes go missing. A lot of it is hidden because these are places where children are supposed to be safe. How many cases of the children that go missing from them ever get reported?"

We urge legislators to take a closer look at funding child protection issues and authorities to use wisdom in investigating abuse cases.

Is there someone to speak for children so that their unfinished lives do not slip silently away? 

If hundreds and hundreds of predictably and preventably dead children is not enough to inspire action, what is?  If you choose not to act, who will?  If not now, when?
